Processing of your Personal Data is necessary for the performance of our services. The legal basis for such processing of your Personal Data is therefore Art. 6(1)(b) GDPR.

We will not share, sell, transfer or otherwise disseminate your Personal Data to third parties, unless required by law according to Art. 6(1)(c) GDPR, unless required for the purpose of your contract according to Art. 6(1)(b) GDPR, unless we are allowed to do so on the basis of a data processing agreement according to Art. 28 GDPR or you have given us express consent to do so according to Art. 6(1)(a) GDPR.

According to Art. 18 GDPR you have the right to request us to restrict the processing of your Personal Data under certain circumstances, e.g. if you think that the Personal Data we process about you is incorrect or unlawful.

According to Art. 20 GDPR, under certain circumstances, you have the right to receive your Personal Data you have provided us with, in a structured, commonly used and machine-readable format and you have the right to transmit that information to another controller without hindrance or ask us to do so.

According to Art. 7(3) you have the right to withdraw your consent to processing Personal Data at any time. A formless message e.g. sent by E-Mail is sufficient to withdraw your consent. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

 

Right to Object

According to Art. 21 GDPR you have the right to object to the processing of your Personal Data under certain circumstances, in particular if we process your Personal Data on the legal basis of legitimate interests (Art. 6(1)(f) GDPR) or if we use your Personal Data for marketing purposes.

For data protection and security reasons we secure the personally identifiable information you provide to us on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. When Personal Data is transmitted by our Website, it is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol or Transport Layer Security (TSL) protocol.

Data Collection on our Website

Server Log-Files

Our Website is saved on a server infrastructure. The provider of the server saves information on Website visits automatically. Such information is saved in so called Log-Files being transmitted by your internet browser to the server automatically. In particular, the following information is transmitted:

In principle, such information are not merged with other data sources.

The legal basis for such processing of your Personal Data are our legitimate interests (Art. 6(2)(f) GDPR) in customizing the content of our Services in line with user preferences and in further improving our Services.

 

Applications/Application Procedure

As part of any recruitment process, we collect and process Personal Data relating to job and apprentice applicants.
We collect a range of Personal Data about you such as:

  • your name, address and contact details, including E-Mail address and telephone number
  • details of your qualifications, skills, experience and employment history
  • information about your current level of remuneration
  • whether or not you have a disability for which the organisation needs to make reasonable adjustments during the recruitment process
  • information about your entitlement to work in Germany
  • equal opportunities monitoring information, including information about your ethnic origin, health and religion or belief.


We collect this information in a variety of ways. For example, data might be contained in application forms, E-Mails being sent to us, CVs, obtained from your passport or other identity documents, or collected through interviews or other forms of assessment.

We will also collect Personal Data about you from third parties, such as references supplied by former employers, information from employment background check providers including information from criminal records checks. We will seek information from third parties only once a provisional job offer to you has been made and will inform you that we are doing so.

Data will be stored in a range of different places, including on your application record, in our IT systems (including email).

We have a legitimate interest in processing Personal Data according to Art. 6(2)(b) GDPR during the recruitment process and for keeping records of the process. Processing data from job or apprentice applicants allows us to manage the recruitment process, assess and confirm a candidate's suitability for employment and decide to whom to offer a job or apprenticeship training position. We may also need to process data from job applicants to respond to and defend against legal claims. We will not use your data for any purpose other than the recruitment exercise for which you have applied. Your information will be shared internally for the purposes of the recruitment exercise. This includes members of the HR department, interviewers and others involved in the recruitment process if access to the data is necessary for the performance of their roles.
If your application for employment or apprenticeship is unsuccessful, we will hold your data on file for two months after the end of the relevant recruitment process. If your application for employment or apprenticeship is successful, Personal Data gathered during the recruitment process will be transferred to your personnel file and retained during your employment.

Should you send us questions or requests via a contact form, we will collect the data entered on the form, including the contact details you provide, to answer your questions or process your requests and any follow-up questions and requests. We do not share this information without your permission.
We will, therefore, process any data you enter into the contact form only with your consent per Art. 6 (1)(a) GDPR. You may revoke your consent at any time. An informal E-Mail to privacy@labcognition.com making this request is sufficient. Alternatively, you may revoke your consent by submitting your email address using the revocation form https://www.labcognition.com/en/revocation.html.
The data processed before we receive your request may still be legally processed.
We will retain the data you provide on the contact form until you request its deletion, revoke your consent for its storage, or the purpose for its storage no longer pertains (e.g. after fulfilling your request). Any mandatory statutory provisions, especially those regarding mandatory data retention periods (6 years in terms of commercial law and 10 years in terms of fiscal law), remain unaffected by this provision.

 

Processing of Customer and Contractual Data

We need your Personal Data to comply with our contractual obligations. Therefore, we have a legitimate interest in processing your Personal Data according to Art. 6(1)(b) GDPR. For example, where you have provided us with your E-Mail address to receive our services or products, we will use this information in order to effectively deliver and communicate information to you in regard to such products and services. We will retain the data you provide us until the contractual obligations are fulfilled. Any mandatory statutory provisions, especially those regarding mandatory data retention periods (6 years in terms of commercial law and 10 years in terms of fiscal law), remain unaffected by this provision.

This Website uses Matomo, a web analytics open-source software. The provider of these services is InnoCraft Ltd., 150 Willis St, 6011 Wellington, New Zealand. Matomo uses Cookies, which are text files placed on your computer, to help the Website analyze how users use the site. hCaptcha

We use the hCaptcha security service (hereinafter "hCaptcha") on our website. This service is provided by Intuition Machines, Inc., a Delaware US Corporation ("IMI"). hCaptcha is used to check whether user actions on our online service (such as submitting a login or contact form) meet our security requirements.
